If you read the 1917 Balfour Declaration (Which
emulated Napoleons 1799 letter to the Jewish community in Palestine promising
that The National Home for The Jewish people will be reestablished in
Palestine, as the Jews are the rightful owners). Nowhere does it state an Arab
entity west of The Jordan River.
The San Remo Conference of April 1920 which incorporated The Balfour
Declaration into International Law with no boundary restrictions it does
not state an Arab entity west of The Jordan River, confirmed by Article 95 in
the 1920 Treaty of Sevres which was signed by all the Allied Powers and the
Treaty of Lausanne.
The Mandate for Palestine
terms does not state an Arab entity west of the Jordan
River . It specifically states a Jewish National Home in
Palestine without limiting or restricting the Jewish territory
in Palestine . It also states that the British should work with
the Jewish Agency as the official representative of the Jews in Palestine to implement the National Home of the Jewish
people in Palestine . I stress again; nowhere does it state that an
Arab entity should be implemented west of the Jordan River .

The United Nations resolutions are non binding
with no legal standing it does not create an Arab Palestinian state and it has
no authority to change the April 1920 San Remo treaty or modify the terms of
the Mandate for Palestine which has the force of international law in
perpetuity.

It is time to relocate the

families that they terrorized and expelled and those expelled Jews were
resettled in Israel . They can use the trillions of dollars in
reparations for the Jewish assets to finance the relocation of the Arabs and
help set-up an economy and industry instead of living on the world charity. The
Arab countries were allocated over 13 million sq. km. with a wealth of oil
reserves.

Why the erroneous use of the term "occupation's policy". The term "occupation" was being used as if it were a bad thing. What the United State recognizes is that Jews have every right to live in, to take up space in, to "occupy", their ancient homeland -- and even to advance it to improved, higher, stages of development. Jews have not taken-over someone else's country; they live in their own country and they uphold legal, documented, property ownership by non-Jews as well as Jews. The Arab-Palestinian narrative that tries to assert Arab sovereignty over the land is nothing but an attempt to reverse the defeat of the Ottoman Turks a century ago. Even under them, Arabs never sought to create a state or territorial region of "Palestine aka The Land of Israel"; and very few people, Arabs or Jews, lived in the territory west of the Jordan River. There were some absentee landlords, some of whom agreed to sell to Jews parcels of what they deemed to be worthless land consisting of swamps and desert at high prices. Arabs today have no more rights to this land than they did at that time (i.e., none), and only a very small percentage of those who live in it now are descended from ancestors who lived in it. Arab claims to it are nothing more than surreptitious warfare against the sovereignty of Jews in this Jewish home-land. If they actually have any intention of pursuing peaceful relations with their Jewish neighbors, they must stop talking about territory and start talking about individual and communal well-being in the towns and villages where they do already live and own property that they, too, "occupy". But the Arabs cannot make peace among themselves for over 1400 years and you expect them to make peace with the unbelievers.
ReplyDeleteThere never has been a country called 'Palestine' anyway so it cannot be occupied. The Russians are still holding territory they occupied belonging to Finland and Japan. They rushed to grab what they could of Japan in 1945 having had a non aggression treaty for the length of the war. If the Japanese had been fighting Russia all along it would have given the Germans an advantage. Of course it would have been an extra burden for Japan as well. The European countries are occupying other countries, UK occupy other countries France occupies Alsace-Lorraine.

After all the Arabs received over 13 million sq. km. of territory (over 6 million sq. mi.) with a wealth of oil reserves after WWI which is currently over 70% vacant, and the Jewish people were allocated all of Palestine aka the historical Land of Israel which is about 118,000 sq. km. but received to date only about 21,000 sq. km. and the British gave away illegally over 77% of Jewish territory in Palestine to the Arabs the Jewish territory east of the Jordan River. They also gave away land west of the Jordan River to the Arabs without authorization.
Add to these formula all the assets of the million Jewish families expelled from Arab countries (who were resettled in Israel) and all their assets confiscated by the Arabs, including, personal property, businesses, homes and over 120,000 sq. km. of Jewish owned land for over 2,600 years (which is 6 times the size of Israel and valued in the trillions of dollars); plus Jordan and now you have all the territorial options where to relocate the Arab-Palestinians.

Why the Arab countries do not settle the Arab-Palestinians in the homes and 120,000 sq. km. of land they confiscated when they expelled a million Jewish families who now live in Israel?
All illegal Arab structures and or communities must be demolished without any delay. They are counting on Israel relenting to the Arab violations. The Arabs see a concession as a sign of weakness and they capitalize on it. They bring in world pressure, but I say it is time to stand up to the Arab violations, no concessions whatsoever.

Site Of The Temple Mount In The Future Jewish Capital Of Jerusalem
ReplyDeleteThe choosing of the site came when G d punished Israel because King David ordered a census of the Jewish people after he defeated of the Philistines in a great battle. The sin was King David's presumption that the salvation of the people came from their sheer numbers and not the Hand of G d. A pestilence followed which only ceased when the prophet Gad advised King David to erect an altar on the stone threshing floor on Mt. Moriah that belonged to Araunah, the Jebusite. So King David purchased the site for 600 silver shekels, for which he assessed 50 silver shekels from each tribe. (1 Chronicles 21:25)
King David built the altar and the plague ceased. The site was on Mount Moriah where Abraham had prepared to sacrifice his son Isaac in obedience to G d's Command as this final test of Abraham's faith. This then was the place where the future Jerusalem was to be built and the site of the First and Second Temples. As a man of war, King David was not allowed to build the Temple, so the task fell to his son King Solomon, who built the First Temple on the Temple Mount
Resolution 181 And The Internationalization Of Jerusalem - An Attempt That Was Never Implemented
ReplyDeleteThe 1947 UN non-binding resolution to internationalize Jerusalem as a "separate body"(corpus separatum) in Resolution 181 of the UN General Assembly only enjoyed the status of a non-binding recommendation. After 10 years a vote was to have been conducted among the city's residents on the issue of sovereignty. When the Jewish residents of the city were besieged by the invading Arab armies in 1948, the United Nations made no response whatsoever and Israel therefore regarded the internationalization proposal as lacking moral basis and as "null and void," in the words of Prime Minister David Ben-Gurion.
There are many Israelis who are insufficiently aware of their rights according to international law. Below are 10 points that are important to know with regard to the struggle over Jerusalem.
A Jewish Majority Resided in Jerusalem Long Before the Reunification of the City
A Jewish majority existed in Jerusalem during the hundred-year period that preceded the establishment of the State of Israel. All the sources confirm that prior to the 1880’s the Jews constituted the majority in the city. Data from the British Mandatory era, between the two world wars, demonstrates that the Jews were nearly 60% of the general population of the city, while the balance of the population was evenly divided between Christians and Muslims. According to the population censuses conducted separately by Jordan and Israel, each one in the area that it controlled in 1961, the city's overall population constituted 72% Jews, 22% Muslims, and 5% Christians.
The Arabs are trans-passers and illegal occupiers on Jewish land it is time to transfer them to Jordan which is Jewish land and or to the homes and over 46,000 sq. mi. of Real estate the Arabs confiscated when they expelled over a million Jewish families. If your logic is that the Arabs are the owners by conquest. Israel regained its territory by conquest while defending itself from Arab aggression.

The United Nations Partition Plan for Palestine was a proposal by the United Nations, which recommended (a non-binding with no legal standing) a partition of Mandatory Palestine at the end of the British Mandate. On 29 November 1947, the UN General Assembly adopted the Plan as non-binding Resolution 181(II).

D. DURATION OF THE SPECIAL REGIME of Jerusalem - The Statute elaborated by the Trusteeship Council on the aforementioned principles shall come into force not later than 1 October 1948. It shall remain in force in the first instance for a period of ten years, unless the Trusteeship Council finds it necessary to undertake a re-examination of these provisions at an earlier date. After the expiration of this ten year period the whole scheme shall be subject to re-examination by the Trusteeship Council in the light of the experience acquired with its functioning.
The residents of the City of Jerusalem shall be then free to express by means of a referendum their wishes as to possible modifications of the regime of the City.
Since majority of the population of Jerusalem is Jewish as has been since the early 1800’s, the vote of a referendum is for The Jewish people to take over the full control and sovereignty of Jerusalem. These terms are now in place and the U.N. or any other entity cannot change those terms. Therefore, any vote or statement by the U.N. or any of its administrative bodies that proposes to change those terms and facts are illegal and have no bearing or legal standing.
It might be asked if the acceptance by the pre-state Jewish Agency of U.N. Resolution 181 constituted a conscious renunciation of Jewish claims to Jerusalem back in 1947. However, according to the resolution, the duration of the special international regime for Jerusalem would be "in the first instance for a period of ten years." The resolution envisioned a referendum of the residents of the city at that point in which they would express "their wishes as to possible modifications of the regime of the city."10 The Jewish leadership interpreted the corpus separatum as an interim arrangement that could be replaced. They believed that Jewish residents could opt for citizenship in the Jewish state in the meantime. Moreover, they hoped that the referendum would lead to the corpus seperatum being joined to the State of Israel after ten years. 11
It is the Arab Conflict, not Israel. The Arabs want what Israel has; which they rebuilt with blood sweat and tears; well they cannot have it.

There is no such entity as Arab Palestinians, they are Arabs from the neighboring Arab countries that most of them crossed the border illegally into Israel and settled there on Jewish land in the past 120 years. The Arab-Palestinian Organization is a terrorist organization just like Hamas and Hezbollah with its leader Mahmmoud Abbas the convicted terrorist murderer.
The Arabs and the world at large must face reality and stop deluding themselves. It is Jewish territory for over 3,700 years and Israel will never surrender it to anyone.
Only with this realization will there be a chance for peace.

Jerusalem is Israel’s Capital for eternity; no other nationality will ever again assume control of Jerusalem
ReplyDeleteWe all must face reality once and for all. As far as the Arabs are concerned, there never was a peace process. It was only a facade to gain control of Jewish territory, since the Arabs could not win in war against Israel. Arafat had stated numerous times that the Arab goal of the peace process is a means to take over all of Israel. The Current Arab Palestinian Charter states these objective and terms by the Arab Palestinians, be it the Arab PA - Fattah or Hamas. Thus, the Arab behavior and actions verify these terms. It is time to face reality. The Arabs do not want peace. It is time to face the factual truth. All the territory west of the Jordan River is Jewish territory. The Arab-Palestinians have Jordan which is also Jewish territory.
Israel can't make peace with the Arab world, until they make peace with themselves, G-d knows we have tried.
ReplyDeleteWe in Israel are not interested in peace with the hostile Arab world. Why, because you the Arabs can’t give something you/they don’t have. The Arab world does not know what peace is or its meaning. Since the 7th century the Arabs/Muslims are in conflict with themselves with no respite, they have killed each other by the millions, their dictatorial leaders are holding them hostage and prosecute and eliminate any resistance. They thrive on creating contention, strife and divisiveness. While the Arab world remains silent. There is no peace in, or outside, the Arab world. We in Israel would love to have peace with the Arabs it would be a tremendous economic benefit to all sides, but first broker peace between the Arab/Muslim groups. Only after a peaceful existence among the Arabs; we will be able to join you in peace.
A good summation by YJ Draiman. It's important to note, though, that not only was the 1947 UN Partition Resolution 181 non-binding because it was a General Assembly resolution and the only binding UN resolutions (only if all parties agree to the resolution) are those made by the Security Council under Chapter VII of the UN Charter but also that the Jews accepted the idea of partition with a caveat. In a statement on behalf of the Jewish Agency on October 2, 1947 to the United Nations Ad Hoc Committee on the Palestine Question, Dr. Abba Hillel Silver endorsed the Partition Plan, as proposed by the United Nations’ Special Committee on Palestine’s report of August 31, 1947. However, he added the following caveat: “If [our] offer of peace and friendship were not welcomed in the same spirit [by the Arab states, including the proposed Arab state of Palestine], the Jews would defend their rights to the end. In Palestine there had been built a nation [i.e. the Jewish people] which demanded its independence, and would not allow itself to be dislodged or deprived of its national status. It could not go, and it would not go, beyond the enormous sacrifice which had been asked of it.” Cited in Grief, 154-155.
As we know, far from welcoming the Zionists' offer of peace and friendship, Arab-Palestinians started attacking Jewish-Palestinians as soon as passage of UN General Assembly Resolution 181 was announced in November of 1947, with Arab-Palestinians killing almost 2,000 Jewish-Palestinians in the ensuing 6 months by the time the Zionists declared their State of Israel in May of 1948. Thus, the UN-recommended partition was never put into effect and Israel is in no way legally bound by it (although the Arab-Palestinians would like to think that Israel is bound by it and much of the world has also swallowed this lie hook line and sinker).
Jerusalem will never be divided again, it is Israel’s eternal Capital.

Israel was hoping that the concessions they made to the Arab-Palestinians would bring peace. It only made the safety and security situation much worse. It is going to be very hard to undue those concessions. As Abbas claimed the Oslo Accord is dead and therefore we must bring back the status quo to the 1992 position. No Arab PA.
It is time to face reality and not live in fantasy land and wishful thinking.
The League of Nations originally created Mandatory Palestine on both banks of the Jordan River. However, on September 16, 1922 in accordance with the Transjordan Memorandum, the League of Nations amended the original Mandate for Palestine to include Article 25. Specifically, Article 25 authorized Great Britain to "postpone or withhold" Jewish close settlement in the area of the Mandate east of the Jordan River." Although the legality of the act remains questionable and is in possible violation of the San Remo Conference Agreements. Britain indeed exercised the alleged right and partitioned the area east of the Jordan River, creating the "territory known as Trans-Jordan" in 1922. As explained above, the Mandatory exempted the application of the Balfour articles (Articles 2, 4, 6, 13, 14, 22, and 23), as well as abbreviating the application of others (Articles 7 and 11) designed to achieve "the establishment of the Jewish national home." See Crawford, The Creation of States in International Law, 428-9. However, it should be noted that no limitation was placed on the other articles, specifically Article 5, which encourages Jewish settlement in Judea and Samaria. This right has never been abdicated and remains consistent with international customary law regarding the concept of “usufruct” embodied in Article 55 of the Hague Regulations (1899 and 1907) even to the extent that Israel could – inaccurately- be viewed as an “occupier”. (While beyond the scope of this report, it can be argued that this same concept would invalidate any land transfers by Jordan during its illegal occupation, and could, at best, have had validity only until Jordan’s withdrawal. The laws of usufruct do not permit the permanent transfer of government land and any such attempts can be seen as void. The validity of such transfers are dubious at best and each case would have to scrutinized in light of land law requirements.)
ReplyDeleteJewish heroism From that remote day 4,500 years ago, when Abraham successfully led his band of “trained young men” against the federated city kings to the rescue of his brother Lot, the city of Salem; the roll of commanders of fighting men is a long and heroic one—Joshua, Gideon, Jephtha, David, Joab, Abner, the Maccabees, Ben Yair, the defender of Masada, whom archaeology has restored to history only recently (after 2,000 years) to name but a few of them—and on down to Generals [Moshe] Dayan and [Chaim] PM Rabin in our own generation.
The British Mandate for Palestine terminated over seventy years ago. However, this basic document—first set forth and agreed upon by the Principal Allied Powers in 1922—established the modern-day legal status of Judea and Samaria, and remains crucial. In fact, the purpose of the Mandate has been fully executed and realized. Israel has become a Jewish homeland, civil and religious rights of the non-Jewish minority are protected, and access to the holy places in Jerusalem is guaranteed to all religions.

No valid treaty, document, or resolution altered this reality. UN non-binding Resolution 181, which proposed a Partition of the territory, was nullified and voided by Arab aggression and refusal to accept the existence of a Jewish state in Palestine. Thus, upon termination of the Mandate in 1948, the Jewish people received sovereignty—the res of the Mandate-trust—over this territory. No subsequent agreement or resolution repudiated Israeli sovereignty over the area defined by the Mandate, which continues to dictate the existence of Israeli sovereignty over Judea and Samaria.
Jordan is the Arab-Palestinian State which is on Jewish land. Legally Israel could under International Law it can take-over Jordan. The British violated International Law when they parceled off over three quarters of Jewish land to the Arabs. Israel has to notify the Arabs who reside west of the Jordan River, and that they the Arabs are there because Israel’s generosity and they have no right to complain. Hebron is the second holiest city in Judaism after Jerusalem. Mecca) and Medina (Medina was a Jewish city named Yathrib) is the holy city for the Arabs which are in Arabia aka Saudi Arabia. Hebron is the holy city to the Jews going back to the days of Abraham which is located in Judea which the Jewish people derive their name.
ReplyDeleteThe UN resolutions are non-binding and have no legal standing the UN has no authority to assign territory or modify international treaties like the April 1920 San Remo Conference that incorporated the Balfour Declaration (without boundary restrictions) as international law and Jewish sovereignty must be applied, you do not need to annexed your own liberated territory. At the Same time they allocated over 6 million sq. km. of territory to the Arabs with a wealth of oil reserves including Jordan as the new Arab state on Jewish land, which is the Arab-Palestinian state. The Oslo Accords are null and void as stated by Abbas at the U.N. Any peace agreement must be approved by the people of Israel.
P.S. Jordan and the Arab countries will have to cooperate. It will be in their best economic interest. Part of the relocation process of the Arabs is funding for the relocation including housing and industry. There is billions of dollars allocated for such transfer. After WWII over 100 million people were resettled. Any Arab who wants to stay under Israel's sovereignty must abide by the laws of Israel and any action whatsoever will result of the immediate expulsion. It is better than spending billions on defense and for the Arabs utilizing their funding for building an economy instead of funding terror and violence.

Israel should stop giving money to the Arab-Palestinians as long as they pay the terrorists and their families and also as long as they commit and promote terror and violence no funds will be forthcoming.

ReplyDeleteThe Arab-Palestinian Leadership encourages their people to kill Israelis. Support terrorists and their families. Arab-Palestinian leaders name streets after suicide bombers and celebrate the death of Israelis. Teach and educate their children to hate Israelis and promote them to violence.
They are Israel’s enemy and must be vanquished and not treated as a legitimate entity, but as a terrorist entity which is no difference than Hamas or Hezbollah.
It is time for Israel to go on a full our offensive to extinguish this terrorist entity and take full control of all of Judea and Samaria. Any Arabs west of the Jordan River who riot or commit violence and resist Israel’s authority must be expelled and their assets liquidated to compensate for the damages.
The Arab-Palestinian leadership is stealing funds donated by world nations and terrorizing their Arab population. It is time to give the Arab-Palestinians who want to live in peace a chance to flourish and expand their economic future. There is no one else that can accomplish this task but Israel.
Time for action is now. Every delay only increases the terror and violence and reduces the safety and security of Israel’s citizens. Do not worry about world opinion; they complain no matter what action Israel takes. Israel must restore complete and absolute safety and security to its people without reservations.
Arabs control 99.9 percent of the Middle East lands, Israel represents one-tenth of 1 percent of the landmass. But that's too much for the Arabs. They want it all. And that is ultimately what the fighting in Israel is all about today. Greed, Pride, Envy, Covetousness. No matter how many land concessions the Israelis make, it will never be enough.
Every leader, and every regime, and every movement, and every organization that steps across the line to terrorism must be banished from the discourse of civilized human life.
